Remortgages

If you are remortgaging a property you own, your mortgage lender or mortgage advisor/broker will ask you to instruct a solicitor as the change of mortgage must be recorded at the Land Registry. 


We would check the deeds to your property and obtain redemption figures for any existing charges. We then draw down the new mortgage and pay off the old mortgage, and then register the change with the Land Registry. Some remortgages can be linked to transfers of equity and details of this are noted in the Transfer of Equity Section below. We can also redeem your Equity Mortgage with Target Help to Buy as part of your Remortgage process’

HELP TO BUY

Repayment

If you have taken out a Help to Buy loan when you purchased your new build property from the Homes and Communities Agency (HCA), you may want to repay this loan at some point. If you want to repay your loan you will be asked by the HCA to instruct a solicitor to help you deal with the repayment and remove the debt from the property.


The important point to note is that this loan will be a percentage of the market value at the time you want to repay the loan and in order to calculate the figure, the HCA will insist on you instructing a RICS valuation. Click below to find out more.

Transfer of Equity

A transfer of equity is the name for changing the names and ownership of a property. So this could be adding someone on to your property deeds, or taking someone off the property deeds.


Sometimes, if you have a mortgage or are transferring and a price is being paid for the transfer, Stamp Duty may be payable so it is important to check this point with your tax/financial advisor or visit the Inland Revenue website for guidance. Equity Release 

Equity release is the name for a type of mortgage available to those over 55. Once you have been advised on the suitability of equity release from your mortgage lender or mortgage advisor/broker you will be asked to instruct a solicitor.

BUY TO LET &

Holiday Lets 

If you are buying a property to let then the buying process is similar to buying a normal property, but your mortgage finance would be a buy to let mortgage and we have to check the property can be used for the type of letting you want to use the property for.


The title deeds to a Property will generally allow for it to be let to one family under an Assured Shorthold Tenancy. However, when a property is to be let as a House in Multiple Occupation (HMO) or a holiday let, the title deeds will need to be reviewed as part of the conveyancing process to check that this has not been prohibited.

Right to Buy

A Right to Buy purchase is a purchase of a property from the Local Authority. If you have rented your property from the Council/Local Authority they may offer you the property at a discounted rate and once the purchase price is agreed you will be asked to instruct a solicitor.
